A permit for temporary residence is a document granting the right to foreigners, as well as stateless persons to be in the territory of the Russian Federation on legal grounds for a period of up to 3 years, until the issuance of residence permit.
After 3 years, a foreigner is obliged to either obtain a residence permit or leave the territory of the Russian Federation. There is no possibility for permit for temporary residence to be extended.
The following categories of persons can apply for permit for temporary residence:
- Foreigners or stateless persons over 18 years of age who legally reside in the Russian Federation;
- Foreigners over 18 years of age who reside outside the Russian Federation, by applying to the Russian federation consulate;
- Russian or foreign national, who reside legally in the Russian Federation on the basis of permit for temporary residence or residence permit, has the right to apply for permit for temporary residence for foreign national under 18 years of age, if he is unable to apply by himself (illness, disability, mental illness, etc.).
There were amendments in the Russian legislation in 2015, under which foreign or stateless applicant for permit for temporary residence is obliged to submit document, confirming his Russian language proficiency, as well as knowledge in history and main laws of the Russian Federation.
There are quotas for entry of foreigners in the Russian Federation. Respectively, documents for permit of temporary residence can be submitted both outside and within the quota system.
The following categories of aliens can apply outside the quota system:
- Spouse of Russian national;
- Alien’s child of minor age is a Russian national;
- Alien was born in the Russian Federation;
- Alien has old aged parents who are the nationals of the Russian Federation.
In other cases an alien has the right to apply for permit for temporary residence only within established quotas.
The holder of permit for temporary residence has the right/obliged to:
- Stay legally in the country for 3-year period;
- Be employed in the Russian Federation, but only in the area of registration;
- The citizens of CIS (Commonwealth of the Independent States) can not necessarily be employed within the established quotas;
- An alien residing in the Russian Federation on the basis of permit for temporary residence is obliged to be inside the country not less than 6 months per year;
- A visa-holder can be issued a multiple-entry visa due to permit for temporary residence.
A holder of the permit for temporary residence is obliged to:
- Be registered with the local branch of the Federal Migration Service no later than 7 working days after the issuance of the permit for temporary residence;
- Be registered with the tax authority of the Russian Federation at the place of residence within 1 year;
- A foreigner is obliged to submit annually certificates and extracts to the migration authority regarding his place of residence, along with income certificates and tax declaration (or other document confirming legal income). Documents submitted within 2 months, before the end of a one-year stay in the territory of the Russian Federation.
