Refugee visa to Australia

According to the United Nations Convention relating to the Status of Refugees, the Australian state must grant asylum to migrants on the basis of established quotas. In accordance with the general provisions of the convention, Australia has the right to introduce its criteria in determining refugee status, relying on local laws and the specifics of territories and states.

Assigning refugee status on the territory of Australia entitles you to a 4 year visa. After 2 years of residence on the territory of Australia without leaving, a person may be granted permanent resident status.

Grounds for applying for a refugee visa

Persons whose rights are violated and who are discriminated in their home country and managed to prove this documentarily, can apply for a refugee visa.

Violations can be defined:

  • By nationality;
  • By race;
  • By religion;
  • By political convictions;
  • Socially based;
  • For humanitarian reasons.

Australia provides several types of visas for refugees, the choice of one of them depends on the grounds for obtaining refugee status:

Visa subclass 790 A visa is intended for persons who have arrived in Australia illegally and want to ask for protection.
Visa subclass 785 A visa is intended for persons who arrived in Australia without a valid visa and want to apply for protection.
Visa subclass 200 Issued to persons who have been recommended by the UN Commissioner for Refugees (issued more often to persons who are on the territory of a country where a humanitarian disaster occurs).
Visa subclass 201 Issued to persons who are prosecuted in their home country, and they cannot leave its territory.
Visa subclass 202 A visa is intended for persons who are subject to discrimination and systematic violation of rights in their home country.
Visa subclass 203  Similar to a subclass 200 visa, but the applicant is obliged to provide the UN Commissioner with documentary evidence of the violation of his rights in his native country.
Visa subclass 204 The visa is intended for persons who are persecuted on the basis of sex (mainly issued to women living in Muslim countries).
Visa subclass 866 The visa is intended for persons who arrived in Australia on a guest or other visa and declared the danger of returning to their homeland. However, the applicant will not have the right to return to his native country, otherwise the refugee visa will be canceled.
Benefits for refugees granted by Australia (provided immediately after receiving refugee status):

    • Financial assistance. The main condition is job search. Persons who have reached the age of 22 can apply for this assistance (on average, the sum contains 1000 AUD).
    • Medical insurance: free treatment and stay in public hospitals (dental services, emergency call, car accidents, accidents, drugs – are not paid by the state);
    • Partial payment for services in private clinics (tests, therapeutic examination);
    • Free kindergartens;
    • Monetary aid for schoolchildren and students of higher educational institutions;
    • The right for employment and recognition of qualifications (after the interview);
    • English courses (up to 510 hours);
    • Psychological rehabilitation of women (for example, victims of violence).

    The Australian government also encourages families with children under the age of 16, and if the child undergoes training further, then under 24 years old. Also members of multiple children families have the right for additional assistance.

    Persons outside the territory of Australia are required to complete a special form  in order to obtain refugee status, in which they are required to convince the Australian state that they are really in danger in their native country and persecuted for one reason or another.

    • A statement to the police and prosecutor’s office about the threat for health and life;
    • Documents about dismissal from work;
    • Articles in the media, videos, cyberbulling.

    All applications for granting refugee status to an applicant are considered on an individual basis, with the circumstances of this request being considered, and the political and economic situation in the applicant’s home country is being is studied.

    During the consideration of an application for granting refugee status, the applicant is granted a “bridging” visa. With its help, a foreigner can find a job, send children to school, as well as legitimize their stay in Australia.

    Relocation and medical expenses for visa applicants for 201, 203 and 204 subclass are paid by the Australian government. Visa 202 subclass is paid by the sponsor (citizen, permanent resident or authorized organization).

    • There are no grounds for granting refugee status (according to international laws, the country is legally stable and humanitarian). There is no reason for granting refugee status;
    • The person is seeking asylum on the basis of the economic development of the country or is being prosecuted for committing a serious crime;
    • Excess of quotas (in this case, the UN sends the application to another country);
    • A foreigner has sought asylum in another country;
    • A foreigner has committed a military crime, a crime against humanity and humannes;
    • There is no reason to grant asylum.
