General concepts
Foreign citizens and individuals without citizenship that have legally arrived to Ukraine are allowed to temporarily stay in the country.
After arriving to Ukraine, foreigners receive a special stamp in their passport, which states the date of their arrival.
The term of the temporary residence depends on the country the person is from.
Foreigners that have entered the Ukrainian territory through a visa are allowed to stay until their visa’s expiration date, unless otherwise provided by international law.
Individuals that do not require a visa are allowed to stay for 90 days in a 180-day period after crossing the border, unless otherwise provided by international law.
It is possible for foreigners to stay longer in Ukraine, if they provide substantial grounds. The migration bodies of Ukraine manage this procedure.
Notice that an individual must apply for a residence permit to work, study at a higher education institution and stay in Ukraine for more than 90 days or the period stated in the visa.
A Ukrainian residence permit is a document that allows foreigners and stateless individuals to stay in the country for a longer period of time (it depends on the type of permit).
A Ukrainian residence permit can be temporary. This permit can be granted for a year with possible extensions. There is also a permit that allows a foreigner to permanently remain in the country, which is called a permanent residence permit. The owner of such a permit must change it every ten years.
The procedure of obtaining a Ukrainian residence permit is subject to migration laws and the decrees of Ministry of Internal Affairs of Ukraine.
There are noticeable differences in the process of obtaining a temporary and a permanent permit. The aspects that differ are the procedure and duration of obtaining the permit, the list of required documents, the permit’s duration and the procedures of changing, as well as the rights granted to the owner of the permit.

The process of applying |
A foreigner is required to collect and submit the necessary documents to the migration body of Ukraine. After submitting the documents, the authorities decide whether to grant or deny a temporary residence permit.
Then most of the time is spent to make a proper decision and provide the issued document. (see more in the section Ukrainian temporary residence permit)

1. Firstly, an immigration permission to Ukraine because of permanent residence is required.
2. This stage includes collecting and submitting documents to the migration authorities of Ukraine, inspection of the candidate by the Security Service of Ukraine, Interpol and the Border Guard Service.
3. Then the corresponding body shall decide whether to grant the permit or not.
4. Submit documents to the State Migration Service of Ukraine to obtain a migration permit. This procedure is basis to extend the duration of stay in Ukraine.
5. Obtain the certificate of permanent residency.

Extension of the duration of stay on the territory of Ukraine

The process of the extension of the duration of stay on the territory of Ukraine for foreigners and stateless individuals is regulated by the order of the Ministry of Internal Affairs of Ukraine of April 25, 2012 #363 “Порядок розгляду заяв іноземців та осіб без громадянства про продовження строку перебування на території України”.
Basis for receiving the service:
- A submitted application to obtain an immigration permit;
- Obtaining Ukrainian citizenship;
- Certain circumstances that preclude exiting Ukraine (pregnancy, childbirth, medical treatment in Ukraine, nursing an ill Ukrainian citizen);
- Applying for inheritance;
- Other cases when there is a necessity to extend the period of stay.
If the inviting party is a legal entity, the person must submit these documents:
- The application of the inviting party;
- A passport or an ID document of a stateless person, copies of pages with personal data, visa (if applicable) and registration stamp and/or copy of the registration card (if applicable);
- A copy of a notarized Ukrainian translation of the foreigner’s passport pages containing personal data or of a personal identification of a stateless individual;
- Passport of the inviting person and copies of pages containing personal data;
- A copy of a permanent or temporary residence permit or other document that confirms legality of stay on the territory of Ukraine (if the host is a foreigner or stateless person);
- A document or a bank statement confirming financial means to cover expenses related to the stay of the foreigner or stateless person on the territory of Ukraine or a letter of guarantee from the host about taking the obligation to pay all expenses related to the stay of a foreigner or stateless person on the territory of Ukraine and their departure from Ukraine;
- A document certifying ownership or certificate of state registration of property rights to the housing provided to accommodate the foreigner or stateless person, together with its copy
- If the dwelling does not belong to the host, a written consent of the owner (co-owner) of the dwelling;
- If the housing is state-owned or belongs to municipality, instead of a document certifying ownership, one should submit a certificate from all adult individuals who reside in this housing facility, together with their written consent to accommodate a foreigner or stateless person.
- Four photographs of a foreigner or stateless person 3,5 x 4,5 cm;
- A receipt confirming payment of government charge for extension of the duration of stay.
When the inviting party is a legal entity:
- The application of the inviting party;
- A passport or an ID document of a stateless person, copies of pages with personal data, visa (if applicable) and registration stamp and/or copy of the registration card (if applicable);
- A copy of a notarized Ukrainian translation of the foreigner’s passport pages containing personal data or of a personal identification of a stateless individual;
- A passport of the head of a legal entity that is the host or a person authorized by the head and copies of pages containing personal data;
- A copy of the abstract from the United State Registry of Legal Entities and Individual Entrepreneurs and Public Organizations of Ukraine;
- A copy of an executive order (an order, statement, judgment, regulation etc.) about appointment of staff members responsible for issuance of notarized documents to foreigners or stateless persons, attested according to the established procedure;
- A document or a bank statement confirming financial means to cover expenses related to the stay of the foreigner or stateless person on the territory of Ukraine or a letter of guarantee from the host about taking the obligation to pay all expenses related to the stay of a foreigner or stateless person on the territory of Ukraine and their departure from Ukraine;
- A document certifying ownership or certificate of state registration of property rights to the housing provided to accommodate the foreigner or stateless person, together with its copy;
- If the dwelling does not belong to the host, a written consent of the owner (co-owner) of the dwelling.
- A receipt confirming payment of government charge for extension of the duration of stay.
Foreigners/stateless persons and hosts shall submit applications requesting extension of the duration of stay on the territory of Ukraine to the State Migration Service of Ukraine not earlier than within ten working days and not later than within three working days before expiration.
If the person failed to apply for extension of the duration of stay and continued to reside in Ukraine, he or she will face administrative responsibility, according to the Code of Ukraine on Administrative Offence. The person would be obliged to voluntary or mandatory leave the country with possible deny of entry for a legally set amount of time.
Grounds for refusal of extension of the duration of stay on the territory of Ukraine:
- For securing national safety and maintaining public order, life and health protection, rights and freedoms, interests of Ukrainian citizens, as well as people legally residing in the country;
- If a foreigner or a stateless person provides a passport or any other personal document that is fake, damaged or does not correspond to the approved sample;
- If a foreigner or a stateless person provides fake documents or documents that contain false data;
- If a foreigner or a stateless person is known to avoid implementation of the court’s decision which includes administrative liability. As well as, if the person is known to have some material or property obligations to a legal entity, a natural person or a governmental establishment, which can serve a reason for departure, especially after the end of the person’s prohibition of entry to Ukraine.
- If there are grounds to believe that a foreigner or stateless person have other basis and purpose for staying in Ukraine, different from those stated in the application;
- If a foreigner or stateless person lacks sufficient financial means for the period of stay or corresponding guarantees from the host.

Obtaining an invitation letter for foreigners to apply for visa documents to enter Ukraine

On April 16, 2017, the Resolution #118 of the Cabinet of Ministers of Ukraine «Об утверждении Правил оформления виз для въезда в Украину и транзитного проезда через ее территорию».
This document regulates the process of obtaining a visa for foreigners and stateless individuals to enter Ukraine and transit through the country.
There are several visa types such:
- Transit (B type) visas;
- Short-term (C type) visas;
- Long-term (D type) visas.
Transit (B type) visas. B type visas are issued in cases where a foreigner/stateless person intends to transit through Ukraine and each transit period does not exceed 5 days. B type visas are issued as single / double / multiple entry visas valid for a maximum of 1 year or another period depending on supporting documents.
Short-term (C type) visas. C type visas are issued in cases where a foreigner/stateless person intends to stay in Ukraine for up to 90 days within every 180 days. C type visas are issued as single / double / multiple entry visas valid for 6 months or another period depending on supporting documents but cannot be issued for more than a 5 year-term.
Long-term (D type) visas. D type visas are issued in cases where a foreigner/stateless person intends to apply for a temporary residence permit to stay in Ukraine for more than 90 days. D type visas are issued as multiple entry visas valid for 90 days.
Documents required for all types of visas (unless otherwise provided by Ukrainian law or international agreements):
- Passport/travel document should comply with these requirements:
- It must be valid for at least 3 months after the intended date of departure from Ukraine;
- It must have at least 2 pages without any visas/marks/stamps;
- It must be issued for no more than 10 years.
- A completed and signed visa application form.
- Disabled foreigners or stateless individuals can submit their visa application through their official representatives;
- Under aged children can submit a visa application signed by their parents or official representatives;
- Individuals mentioned in the applicants’ documents and those, who accompany them must submit their own visa applications.
- The applicant’s coloured photograph (size 3,5 x 4,5 cm).
- A valid medical/travel insurance, which should provide a minimum of €30 000 coverage.
- При оформлении многократной визы, полис медицинского страхования должен быть действителен на момент первой поездки в Украину.
- Proof of sufficient funds to cover the costs of the stay and return.
- This document must be submitted during transits as well;
- It is also possible for the applicant to provide a document, stating that the person can legally earn the sufficient funds in Ukraine.

- A receipt of payment of the visa fee (unless otherwise provided by Ukrainian law or international agreements).
One of the requests for obtaining a short-term visa (single-, double- and multiple-entry) is an invitation letter to Ukraine.
Both legal entities and natural persons can issue an invitation letter for a foreigner or a stateless individual.
A legal entity, registered in Ukraine, must submit the invitation on an official form.
The personal data of the inviter must be stated in the invitation: the number stated in the United State Register of Legal Entities, Individual Entrepreneurs and Public Organizations of Ukraine, the registration number, the date and signature. Necessary data: the inviter’s full name, the date and place of the person’s birth, citizenship, the passport data, residence place, the reason to enter Ukraine, the period of the stay, the number of entries and the inviter’s residence place in Ukraine.
The inviter must bear the costs of the stay and return of the invited person.
A natural person (a Ukrainian citizen or a foreigner residing in Ukraine on a basis of a residence permit) must issue an invitation through a notary.
One must state in the invitation his or her full name, passport data or the data of the residence permit and the residence address. The invited person’s data must be provided as well: the inviter’s full name, the date and place of the person’s birth, citizenship, the passport data, residence place, the reason to enter Ukraine, the period of the stay, the number of entries and the inviter’s residence place in Ukraine.
In addition to the invitation, one should submit a copy of the Ukrainian passport or of the residence permit.
Foreigners can apply to their local Consulate or diplomatic body to obtain an invitation, not earlier than three months before the date of arrival to Ukraine.

The process and conditions of immigrating to Ukraine are managed by the Law of Ukraine “Про імміграцію” and by Resolution of the Cabinet of Ministers of Ukraine of December 26, 2002 #1983 “Про затвердження Порядку формування квоти імміграції, Порядку провадження за заявами про надання дозволу на імміграцію і поданнями про його скасування та виконання прийнятих рішень».
The immigration permit can be obtained within and beyond immigration quotas, which are established by the Cabinet of Ministers of Ukraine.
Immigration permits within the established quotas are granted to:
- Individuals working in the areas of science and culture, whose immigration would be in the interests of Ukraine;
- Highly-skilled specialists and workers who whose skills would be appreciated in the country;
- Foreigners who have invested finances in the Ukrainian economy (not less than 100,000 USD);
- Individuals who are full-blood siblings, grandparents or grandchildren of a Ukrainian citizen;
- Individuals who were formerly citizens of Ukraine;
- Parents, spouses of immigrants and their minor children;
- Individuals who continuously lived on the territory of Ukraine for three years after they were recognized as victims of human trafficking.
Immigration permits beyond the established quotas are granted to:
- Foreigners married to Ukrainian citizens for longer than two years, as well as children and parents of Ukrainian citizens;
- Individuals who are guardians of Ukrainian citizens or are under guardianship of a Ukrainian citizen;
- Individuals who have the right to acquire Ukrainian citizenship on the basis of their geographic origin;
- Individuals whose immigration is the matter of national interest for Ukraine;
- Foreign Ukrainians, spouses of foreign Ukrainians, their children if they are entering Ukraine together and are to stay in the country.
Required documents:
- An application for immigration permit (общий, от законного представителя несовершеннолетнего или недееспособного лица);
- 3 photographs printed on matte paper (size 3,5 x 4,5 cm);
- A notarized Ukrainian translation of the foreigner’s passport or of a personal identification of stateless individual;
- A document confirming the person’s residence in Ukraine and abroad;
- Information about the foreigner’s family;
- A copy of marriage certificate (if the applicant is married);
- A document confirming the person’s basis to obtain an immigration permit (marriage with a Ukrainian citizen, family etc.);

Application for a Ukrainian temporary residence permit

A Ukrainian temporary residence permit is an identification card of a foreigner or stateless person that allows them to stay in Ukraine on a legal basis. It is granted for a year with possible extensions.
The process of obtaining such a permit is managed by Laws of Ukraine “Про правовий статус іноземців та осіб без громадянства”, “Порядком оформлення, виготовлення і видачі посвідки на постійне проживання та посвідки на тимчасове проживання”, approved by the regulation of the Cabinet of Ministers of Ukraine of 28 March, 2012 #251 and “Тимчасовим порядком розгляду заяв для оформлення посвідки на постійне проживання та посвідки на тимчасове проживання”, approved by the order of the Ministry of Internal Affairs of Ukraine of 15 June, 2013 #681
Once you have reached sixteen years, you are eligible to apply for a temporary residence permit.
Foreigners and stateless individuals can apply for a temporary residence permit at a local migration body at the place of their residence.

For foreigners that are illegally residing in Ukraine and for some reason haven’t been forcibly departured and are kept in Migrant Accommodation Centres
After providing all the required documents to a local migration body in Ukraine, the average processing time of a temporary residence permit application is 15 business days.
To extend a temporary residence permit, a person must file an appropriate application minimum 15 days before the expiration date of the permit.
Grounds for refusal of granting a temporary residence permit:
- For securing national safety and maintaining public order, life and health protection, rights and freedoms, interests of Ukrainian citizens, as well as people legally residing in the country;
- If a foreigner or a stateless person provides a passport or any other personal document that is fake, damaged or does not correspond to the approved sample;
- If a foreigner or a stateless person provides fake documents or documents that contain false data;
- If a foreigner or a stateless person is known to avoid implementation of the court’s decision which includes administrative liability. As well as, if the person is known to have some material or property obligations to a legal entity, a natural person or a governmental establishment, which can serve a reason for departure, especially after the end of the person’s prohibition of entry to Ukraine.

Application for a Ukrainian permanent residence permit

A Ukrainian permanent residence permit is an identification card of a foreigner or stateless person that allows them to reside in Ukraine for an unlimited period of time. It also grants them the same rights and freedoms, as Ukrainian citizens have, except the right to elect and be elected, as well as the ability to hold public office.
The process of obtaining such a permit is managed by Laws of Ukraine “Порядком оформлення, виготовлення і видачі посвідки на постійне проживання та посвідки на тимчасове проживання”, approved by the regulation of the Cabinet of Ministers of Ukraine of 28 March, 2012 #251 and “Тимчасовим порядком розгляду заяв для оформлення посвідки на постійне проживання та посвідки на тимчасове проживання”, approved by the order of the Ministry of Internal Affairs of Ukraine of 15 June, 2013 #681
Depending on the circumstances of arrival, a Ukrainian permanent residence permit can be obtained within or beyond immigration quotas.
The main requirement for a foreigner or a stateless individual to obtain a Ukrainian permanent residence permit is to possess an immigration permit.
A permanent residence permit does not have a time limit. A person must change the permanent resident’s certificate every ten years and in the age of 25 and 45.
A Ukrainian permanent residence permit allows:
- Arrival to Ukraine without a visa or any other document;
- Reside in Ukraine for an unlimited period of time;
- Labour in Ukraine without additional governing body’s permits.
Required documents for a Ukrainian permanent residence permit:
- The foreigner’s or stateless person’s application;
- A notarized Ukrainian translation of the foreigner’s passport or of a personal identification of a stateless individual;
- A copy of the immigration permit;
- A receipt of state duty payment;
- A receipt of services payment;
- Four photographs printed on mat-surface paper (size: 4,5×3,5);
- A copy of the tax identification number (if a person obtains one).
An individual must apply for a permanent residence permit while the immigration permit is still valid (it is granted for one year).
Grounds for refusal of granting a temporary residence permit:

Leaving Ukraine for permanent residence
- Processing time – up to 3 month

The Law of Ukraine «Про громадянство» allows individuals, who permanently reside abroad, to renounce of Ukrainian citizenship. However, the sole fact of permanent residence abroad does not mean that the person has met all the requirements of the Ukrainian legislation.
To reside abroad legally one should obtain a permit to leave Ukraine for permanent residence. (An individual receives a stamp “permanent residence” with the chosen country)
The process of obtaining a permit to leave Ukraine for permanent residence:
- An individual should submit an application to the State Migration Service of Ukraine at the place of residence;
- Then the person receives the permit;
- After that the person is to be removed from previous residence place in Ukraine;
- Finally, the person obtains the “permanent residence” stamp with the chosen country stated.
If the person is already residing abroad, he\she must approach the Consulate of Ukraine at the residence place.
Important! In Ukraine, the processing time is about 3 months, but abroad it will take up to 12 months. At the consulate, the person must provide a Ukrainian passport, valid for at least a year from the date of applying for the permit.
Important! According to the Family Code of Ukraine, if a Ukrainian citizen got married abroad, he\she must change the national passport within a month. To change the passport one need to approach the local State Migration Service of Ukraine. Then, with a new passport, a person obtains the permit to leave Ukraine for permanent residence abroad.
List of required documents:
- An application for obtain a permit to leave Ukraine for permanent residence abroad;
- Three photographs printed on mat-surface paper (size 4,5 x 3,5 cm);
- A Ukrainian passport (for citizens over 14 years);
- A birth certificate (for children under 14 years);
- A personal document of the trustee;
- A document confirming the trustee status (exceptions: parents or adoptive family);
- A notarized agreement of the trustee, who remains in Ukraine, for his client to leave Ukraine (or a copy of death certificate, a copy of court’s decision on depriving of parental rights, a copy of a document confirming person’s (partial) disability, a copy of the document stating the person is missing or dead). The agreement can be submitted in person when the applier is obtaining the permit;
- A notarized statement of consent for the child to leave Ukrainian for permanent residence abroad (for children aged 14 to 16 years);
- A copy of the court’s decision, if one of the trustees, does not agree for a child under 16 or a (partly) disabled person to move abroad for permanent residence;
- A statement from the tax service about the absence of public debt.
Important! The stamp does not influence the validation period of the Ukrainian passport.
The processing time is no longer than 3 month after approaching the migration authorities.
Grounds for refusal:
- If the individual dealt with classified information, until the period stated in Article 12 of the Law of Ukraine «Про порядок виїзду з України і в’їзду в Україну громадян України» expires;
- If the individual has unpaid alimony;
- If the individual appeared in a criminal case, until the case is closed;
- If the person was charged with a crime, until the sentence is served or the charges are dropped;
- If the person refuses to fulfil the court’s decision, until the obligation is settled;
- If the person has provided false data;
- If the person is enlisted, until obtaining a draft deferment;
- If the person is under administrative supervision of Ukrainian police, until the end of the supervision.

Returning to Ukraine from permanent residence abroad
- Processing time – up to 1 month
- The price depends on the personal circumstances of the applier.
According to Article 33 of the Constitution of Ukraine, any Ukrainian citizens that have left to reside abroad, can return to their motherland anytime.
To move abroad for permanent residence, Ukrainians need a tourist passport and a travel document for a child.
Any Ukrainian can return to the country with this passport, without applying for some additional documents.
The list of required documents is stated in Article 2 of the Law of Ukraine «Про порядок виїзду з України і в’їзду в Україну громадян України».
First step: removing oneself from the consular register at the residence place abroad (in Ukraine)
Before returning to Ukraine, the person that was registered in a Consulate of Ukraine abroad must remove himself from the consular register. Therefore, one should provide an application of removal from the consular register due to returning to Ukraine, a tourist passport and a receipt of the consular fee payment. After providing these documents, the person is removed from the register right away and receives a stamp in the passport, confirming this procedure.
If there is no opportunity to submit the documents in person, they can be sent by post.
If one decided to stay in Ukraine while being in the country, this procedure can be done at the local State migration service of Ukraine at the chosen residence place.
Important! One can be registered in the consulate again only after obtaining a new permit to move abroad for permanent residence.
Second step: choosing a residence place in Ukraine
The process of choosing a residence place and registration in Ukraine is managed by the Law of Ukraine «Про свободу пересування та вільний вибір місця проживання в Україні». Therefore, one can freely choose a residence place in Ukraine, except cases, stated in the law. According to Article 6 of this law, a Ukrainian must register his or her residing place during 10 days after moving to the place.
List of required documents (must be provided in person or by a trustee):
- An application;
- A document stating the place of residence;
- A birth certificate or a certificate of obtaining Ukrainian citizenship for children under 16 years;
- A receipt of the state charge payment or a document that allows exemption from payment;
- A certificate of removal from previous residence place, if moving in Ukraine; If the person registers at a new place, when removing from other, then the certificate is not required.
- Documents confirming the right to reside in a house or in a special social institution, social protection or care institution, or in a military unit number for further military service, as the place will be registered as the person’s residence place;
- A military ID card or a military service registration certificate (for enlisted).
Step three: obtaining a Ukrainian passport
The process of granting a Ukrainian passport is managed by the Regulation of the Verkhovna Rada of Ukraine «Про затвердження положень про паспорт громадянина України та паспорт громадянина України для виїзду за кордон».
The processing time of obtaining a Ukrainian passport is 1 month. It is registered on the basis of residence.
List of required documents:
- An application (introduced by the Ministry of Internal Affairs of Ukraine);
- A birth certificate;
- Two photographs printed on mat-surface paper (size 4,5 x 3,5 cm);
- Documents confirming Ukrainian citizenship (if required) (a tourist passport, a travel document for a child).
Important! The stamp of moving abroad for permanent residence does not influence the validation period of a Ukrainian passport. The processing time is no longer than 1 month after submitting document to the migration body of Ukraine.
Grounds for refusal:
- The application did not meet the requirements.
